Media Release: Delay in making asset declaration public is unacceptable



Petaling Jaya (Wednesday): C4 Center refers to news reports stating the Malaysian Anti-Corruption Commission (MACC) has postponed the display of information on asset declaration by all Cabinet members and members of Parliament which was supposed to be provided on its website on 15 October 2018.

C4 Center is concerned to learn about this delay given the Prime Minister’s announcement after a meeting with the special cabinet committee on anti-corruption on 9 July 2018 stating that all cabinet ministers and members of Parliament are required to declare their assets to the MACC in due course. In addition, the MACC has committed to facilitating the process of making asset declaration public by uploading the relevant information on its website.

C4 Center would like to emphasise that Malaysian tax payers have a right to know the real reasons for the delay and further delay in implementing asset declaration and its display on the MACC website is not acceptable.

Given the urgency of the matter, we call on the MACC to display available information on asset declaration and name those have failed to provide the information on its website on 1 November 2018. We would like to reiterate that asset declaration would only be effective and transparent if it is made public.

C4 Center would like to reiterate that it had authored a Public Asset Declaration Framework (PADF) with the Bar Council prior to the 14th General Elections. With the PADF, C4 Center and other good governance civil society groups have been lobbying the government to eventually institutionalise a robust asset declaration law in Malaysia. The PADF outlines principles of best practice as well as a sample declaration form which is immensely comprehensive.

We would like to reaffirm our call for the enactment of a federal freedom of information law. A radical shift for a clean and accountable government can only be achieved by having, among others, a robust asset declaration law which provides for public scrutiny.

It is noteworthy that people play an important role as a check and balance against kleptocratic tendencies at every level, for whichever government of the day holding power. A comprehensive and effective asset declaration law which mandates public scrutiny is therefore key to ensuring that those who occupy positions of power discharge their duties with integrity.
